What is a patent?
A patent is an exclusive right to an invention. With a patent, you can prevent others from making, using, or selling your invention. This can be a technical product or an innovative process.
A patent is valid for a maximum of 20 years from the date of filing. The application is published in a patent register, so that the knowledge eventually becomes available to the public. This balance between protection and public access stimulates technological progress: once patent protection has expired, anyone can freely use and further develop the technology.
To obtain a valid patent, an invention must be new, inventive, and industrially applicable. This means that the solution must not be obvious to a person skilled in the relevant technical field.
Hoe werkt het aanvragen van een octrooi
Het aanvragen van een octrooi verloopt per land iets anders, maar globaal gezien volgen octrooiprocedures een aantal vaste stappen. Hieronder vind je een overzicht van de belangrijkste fases in het proces van een octrooiaanvraag.
1. Onderzoek naar bestaande octrooien
Vooraf kun je een nieuwheidsonderzoek laten uitvoeren om te beoordelen of jouw uitvinding nieuw en inventief is. Dit geeft inzicht in de kans van slagen van een octrooiaanvraag en helpt om mogelijke conflicten met bestaande octrooien te voorkomen. Dit onderzoek is optioneel.
2. Opstellen van de octrooiaanvraag
Een octrooigemachtigde stelt de aanvraag op. Deze bevat een volledige en nauwkeurige beschrijving van de uitvinding, inclusief conclusies die de beschermingsomvang bepalen. Alle relevante technische informatie moet direct worden opgenomen; na indiening mag de inhoud niet meer worden uitgebreid.
3. Indienen van de aanvraag
Wanneer de octrooiaanvraag gereed is, wordt deze ingediend in het land van eerste keuze. Hiermee stel je een indieningsdatum vast, die een grenslijn vormt tussen wat wel en niet relevant is voor de nieuwheid van je uitvinding. De aanvraag wordt ingediend bij de officiële instantie van het gekozen land, bijvoorbeeld Octrooicentrum Nederland (OCNL), the European Patent OfficeEPOand the United States Patent and Trademark OfficeUSPTO) Binnen twaalf maanden kun je de octrooiaanvraag uitbreiden naar andere landen of regio’s.
4. Onderzoek en beoordeling
De officiële octrooiverlenende instantie voert een nieuwheidsonderzoek uit. Daarbij wordt beoordeeld of de uitvinding nieuw, inventief en industrieel toepasbaar is. Dit onderzoek vindt normaliter binnen een jaar na indiening plaats, zodat de resultaten kunnen worden meegenomen in de beslissing om de aanvraag internationaal verder voort te zetten.
5. Verlening van het octrooi
Na afronding van de procedure kan het octrooi worden verleend. In sommige landen gebeurt dit alleen wanneer de uitvinding daadwerkelijk nieuw en inventief wordt bevonden. In andere landen wordt een octrooi standaard verleend, waarbij eventuele discussies over geldigheid pas later via de rechtbank kunnen ontstaan.
Een octrooi heeft meestal een maximale looptijd van 20 jaar vanaf de indieningsdatum. Om het octrooi gedurende deze periode geldig te houden, moeten instandhoudingstaksen worden betaald, vaak jaarlijks.

Cost of a patent application
The cost of a patent varies depending on the country, the type of invention and its technical complexity. Generally speaking, the total cost of a patent comprises three components:
- Initial costs
This includes drafting and filing the patent application with the official body. Depending on the scope and complexity, these costs average between €6,000 and €10,000. - Costs during the grant procedure:
These are the costs that need to be incurred during the patent application process. In countries where patents are granted automatically, these costs are limited to a few hundred euros. In countries with an substantive examination procedure, the costs can run into several thousand euros. - Annual maintenance charges:
In order to maintain a patent (and, in some countries, a pending application as well), annual maintenance fees must be paid. These start at a low level and increase as the patent ages. The amount varies considerably from country to country.
