Protocol (Section 3.7.2) of Article 69 reads, \u201cThe scope of protection of the European patent shall be determined by the claims.<\/p>\n<\/div>\n\t<div class='ewd-ufaq-faq-body' >\n\n\t\t\n\t\t\t\n\t\t\n\t\t\t<div class='ewd-ufaq-post-margin ewd-ufaq-faq-post'>\n\t<p>To determine whether there has been an infringement of a <a href=\"https:\/\/custos-ipc.nl\/en\/patents\/\">patent<\/a> Article 69 of the European Patent Convention is invoked (<a href=\"https:\/\/nl.wikipedia.org\/wiki\/Europees_Octrooiverdrag\">EOV<\/a>). Protocol (para. 3.7.2) of Article 69 reads: \u2018<strong>The scope of protection of the <a href=\"https:\/\/custos-ipc.nl\/en\/faq\/there-is-a-european-patent\/\">European patent<\/a> is determined by the conclusions<\/strong>. Nevertheless, the description and drawings serve to explain the conclusions'.<\/p>\n<div style=\"border: 2px solid #D8C039;padding: 20px;margin: 20px 0;border-radius: 4px;background-color: #fff;font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;line-height: 1.6\">\n<h3>When is there patent infringement?<\/h3>\n<p><a href=\"https:\/\/custos-ipc.nl\/en\/faq\/who-monitors-whether-someone-infringes-my-patent\/\">Patent infringement<\/a> occurs when someone manufactures, uses, sells, or imports the protected invention within the protected territory without permission. Offering, possessing, or transiting the invention may also constitute infringement.<\/p>\n<\/div>\n<p>Several types can be distinguished, namely:<\/p>\n<ul>\n<li><u>Literal infringement<\/u>: this occurs when someone uses the invention, i.e. all the features, from the independent claim(s) of a <a href=\"https:\/\/custos-ipc.nl\/en\/faq\/what-is-a-patent\/\">patent<\/a> applies.<\/li>\n<li>There is <u>equivalent infringement<\/u> when means that do not read literally under the text but can be considered equivalent achieve the same result. In these situations, explanations may vary from country to country.<\/li>\n<li>There is <u>indirect infringement<\/u> in supplying an essential element of the invention if it is known or obvious in the circumstances that those means are suitable and intended for that application.<\/li>\n<\/ul>\n<p>Need advice?
